Isn't that more of a confidentiality issue? Since the client had already fired Patty PRIOR to hiring Tom, what he was privy to couldn't hurt her business.

I think that it would be a real conflict of interest if he switched to Frobisher's side. I'm not sure how Tom's involvement in the case working with Patty would conflict when he was (briefly) representing them solo.
