The asthma attacks have come from paint fumes and dust from floor buffing. I don't think cleaning will be as bad as walking into that was. Blech.

You definitely should, because (1) they violated the terms of your lease by entering the apartment repeatedly during the last month to paint, etc.; (2) when they entered the apartment -- ILLEGALLY -- to paint, etc., they DAMAGED items belonging to you (i.e., papasan, X-box [or whatever video game system that is]); (3) the painting and floor buffing they did when they entered your apartment ILLEGALLY has caused asthma attacks.

Basically, they violated the terms of your lease, damaged your property, and put your health at risk.

If you DON'T sue them, I'm going to glare *very* disapprovingly at you.

Imagine if things were flipped around. If you violated the terms of the lease, they'd come after you. (In fact, when you tried to get them to cut you a break on this last month, they said no -- so basically they're okay when THEY violate the lease, but you don't get to do the same.)

If you damaged their property (holes in the wall, carpet in flames), they would *totally* withhold money from your deposit, rightfully so. Well, *you* have the right to recover damages for *your* property that they damaged (when they entered your apartment ILLEGALLY, in clear violation of the lease).

If you did anything that put the health of other tenants at risk, they'd be all over you. Your asthma isn't just mild, occasional asthma; you've been hospitalized in the recent past because of it. And by being in your apartment when they had no right to be there (ILLEGALLY, if I haven't mentioned it recently), they created an unhealthy living situation for you. It doesn't matter that you weren't living there 24/7 -- if you were required to pay rent, then they are required to treat you like a tenant, and obey the lease.

Don't make me glare disapprovingly at you -- SUE THEIR ASSES.
