I think that's canon that they may conveniently forget.
I think there has been recent-ish dialog implying that the 12 regenerations isn't hard and fast.

My understanding was 12 regeneration, 13 possible doctors. But then River transferred her remaining regenerations to him so that could be used for hand-wavium more options.

The third Doctor was older than the second, so if it was canon, it wasn't canon for long.
