Allyson, let me know if I can paypal you anything--money for a ticket home, if your brother needs help with a lawyer, anything. If I were you, I'd go home. I would have done the exact same thing as your brother.
I would suggest a good lawyer, no matter what. That's the best thing to do immediately. I can't see them wanting to press charges and I certainly can't see a jury convicting your brother of anything considering the circumstances. But don't take chances.

I'm getting very angry that none of this seems to have made the RI news at all. A man who lives in RI is accused of assaulting a child and it doesn't even make the news.

Backing Cashmere 200% on the good lawyer, emphasis on good. A good one can minimize whatever damage there may be, and is worth whatever s/he charges. I'm willing to chip in what I can toward the costs, either of your ticket home or the lawyer.
--And please don't let anybody think that because the boy's dad was in the right that he doesn't need a lawyer. Courts are best navigated by those familiar with them.
Joining the "find a good lawyer" bandwagon. Because Beverly's right. (Not to mention that, if the guy denies everything in court, a good lawyer will be more likely to find and poke holes in his story.)
I don't know whether "defense of preschool-age son" would be a defense as a matter of law. But I don't see any jury convicting on those facts.

Restraint? The hell? I'm a krav brown belt and I'm not sure how I'd go about restraining a grown man and calling 911 until 911 got there. In general, hit them until they can no longer be a threat--I guess it primarily matters how much he hit him. But that's a dicey as hell line, and dangerous too.
Please tell me they just charged your brother and that they didn't take him into custody.
