In the prison? He was the dude that set up Nate and his team in the pilot ep (had them steal airplane plans and then tried to kill them all) and got taken in "The Nigerian Job"

There was plenty of theoretical time for him to exit though the opposite side of the building, if they want to play TV explosions.
