When other medical professionals have devised a treatment plan that's meant to be carried out by another doctor (meaning, the neurologist and migraine specialist came up with the plan intending for an ER doctor to carry it out), and the doctor ignores that treatment plan, I would call that negligentBut the question is what can the clinic do-- doctors should have the right to make an independent diagnosis, and I would wonder how much Monday-morning quarterbacking the clinic is permitted when there's no clear evidence of mistake. I wouldn't call failing to follow a specialist's recommendation clear mistake, especially when a reason is given. That's why I think it's important to point to the circumstances other than just simply making a different diagnosis.
