Do you think the gerund should take the accusitive? The ablative, -ndo, goes to "by understanding".....hmm, maybe the accusitive is better.

Not necessarily. The documents can be filed under seal, which means that only certain people can see them. It's done for grand jury investigations, for example. Also, in some high profile cases. Plus, the wife apparently had been having a long time affair with a police officer.
