I received your message on May 16, 2007. From this point on, I will be communicating with you via email.

After listening to your message last night, and after reading the attached email, I did some more checking to make sure I understood the situation in full. I discovered the following:

1)ABF is UPack’s parent company. Neither company receives a “cut” of any shipment.

2)ABF/UPack does not split payments, nor are there any records or notes on the account of any such agreement. It is ABF/UPack’s company policy to not release any goods to anyone without final payment. The credit card payment that you made on May 15, 2007 has, in fact, paid the account IN FULL.

As you stated in your last email and in previous phone conversations, we agreed to spilt the cost of shipping 50/50. You also stated in previous conversations that you would reimburse me $150.00 for the cash payment to Tom Frizzell, Sr. for the transport of our goods from Toluca Lake to Pico Rivera, as well as Joe’s time and labor in the pick up and transport of your goods from Principal Entertainment in Los Angeles to Pico Rivera.

I am requesting a refund via Google Payments – the method by which I paid you on May 1, 2007 – of $367.50. If this refund is not received by May 18, 2007, then I will rescind the original payment of $620.00 and will, upon receipt an invoice for $402.50 which represents 50% of the final shipping charges, plus a credit for $150.00 which represents our cash payment to Tom Frizzell, Sr. This invoice should total $252.50. Upon receipt of such, I will issue you a check for this amount.
