Hec, or anyone with any California employment law knowledge, I'm asking the following for a friend: What is the legal definition of a hostile work environment (in CA)? Thanks.

There are a bunch of tests that need to be satisfied to qualify. The most obvious stuff would be quid pro quo "you give me sex and I'll give you a bonus" type, or Inappropriate Touching. Beyond that you need a consistant behavior which is tolerated by management which creates the hostile work environment. Examples being: constant racist or sexist jokes or comments, allowing blatantly sexual posters or calendars up. Things like that.

However, this is a pretty difficult standard to prove in court - you almost need to get it read in the minutes of official meetings. Or you need wide corroboration and documentation - which is difficult unless it's a group of individuals making the charge.

It's mostly the documentation issue that's tough.

Feeling a bit better even though it's still leaking like craxy. I wanted to try turning the water off but when I Googled, there was a site talking about "TURN OFF THE GAS FIRST" and I was like "Holy shit, I ain't taking any chances. Better a water leak than an explosion." Hope I made the right call...

Cindy, the stuff Hec is talking about is quid pro quo harassment, which is tied in with hostile work environment, but not precisely the same thing. HWE does not need to be sexual harassment-- it can be any type of harassment.

If you can wait until I get to work, I can get you a very precise definition.

Even apart from sexual harassment, I'll note that proving a hostile work environment is difficult to document. However, I'll also note that a lot of companies will settle rather than go to court.
