There are a bunch of tests that need to be satisfied to qualify. The most obvious stuff would be quid pro quo "you give me sex and I'll give you a bonus" type, or Inappropriate Touching. Beyond that you need a consistant behavior which is tolerated by management which creates the hostile work environment. Examples being: constant racist or sexist jokes or comments, allowing blatantly sexual posters or calendars up. Things like that.
However, this is a pretty difficult standard to prove in court - you almost need to get it read in the minutes of official meetings. Or you need wide corroboration and documentation - which is difficult unless it's a group of individuals making the charge.
It's mostly the documentation issue that's tough.
Is it all sexual harassment related?

Cindy, the stuff Hec is talking about is quid pro quo harassment, which is tied in with hostile work environment, but not precisely the same thing. HWE does not need to be sexual harassment-- it can be any type of harassment.
