If so, then double jeopardy should apply. Why didn't I think of that when I saw the promo? Wasn't Joss in the snippet on UPN.com? Or was he in the promo shown this week on tv?

On edit: okay then they (the prosecution ) would have the ability to use new evidence to reopen the case, right?

Well, double jeopardy only applies in cases where the whole megilla went to trial, not just grand jury. Once you've been acquitted of a crime, you're scot-free, but the grand jury is the body that determines whether you go to trial, not the trial itself. (They have different evidence and procedure rules, because their job is only to decide whether there's a good enough case to proceed or not.)

I (for some reason) thought it was a trial -- but it makes more sense that it was a grand jury.

Or in other words -- I should re-watch the season 2 premiere.

Thanks tiggy! (And yay for Spoilage lite!) The ep description on my Replay had already spoiled the Abel Koontz appearance and plotline. I'm so happy they jumped forward to the election because I didn't want that being a subplot the whole season.
