But they can still dismiss it? So the pro-ssm 9th Circuit opinion would stand?

If the Supremes dismiss the case (on the grounds the proponents of prop 8 do not have standing to bring the case to the Supremes), the 9th Circuit case striking down prop 8 would stand

I paid about $200 the one time I had my taxes done at H&R Block. As it turned out the preparer didn't do anything but plug info I'd already organized and provided into her computer screen and get the same result I had at home. But I was working with an unfamiliar form thanks to capital gains (goodbye, 12 shares of Disney stock that was going to cost me $60 a year to keep!), and wanted the peace of mind of a professional signing off on it.

Which would mean that marriage equality would be re-established in California, but wouldn't establish a precedent for the rest of the country, and wouldn't commit them to saying there's an equal protection right to marriage regardless of gender.

So, would that bode ill for tomorrow's hearing on DOMA?

I would say that if the Supremes dismiss the Prop 8 case on standing, then they are unlikely to get to the merits on DOMA if they can avoid it.

So I interpreted that correctly. Well, that blows. I mean, it would be good that the 9th Circuit ruling on Prop. 8 would stand, but if this means that SCOTUS doesn't want to rule on DOMA, that blows.

Ugh--why would they TAKE DOMA unless they want to say something about it? So weird.

Sounds like the best option for a conservative court and GOP handlers who don't want the bad publicity of ruling against a popular stand.

edit: ie, saying "No, that's not really a matter for the Supremes."

DOMA is a federal law and they may have to be more definitive about dealing with it, rather than ruling on a state law.
