actually, his state of mind can be crucial in escalating a charge from manslaughter to murder, or from an assault to a hate crime. There is also a common law concept called "imperfect self defense", which means that the defendant was truly afraid and acted in self defense, but a "reasonable man" would not have been afraid in those circumstances. I'm not sure that it could be used here, though.
Either way, he should have been brought in for questioning, because no matter what else, he shot an unarmed man in the street.

Jesus, my formerly best friend who has some serious mood issues, and who has "dumped" me before, has taken it upon herself to send me a FB message saying "obviously we are no longer friends." Because that is kind of crazypants, I responded in case that it was a spam thing. Nope, I have taken too long responding to an email about some bad news about a mutual friend so we are no longer friends.
Sigh. I know she's stressing out hard about our (mostly her, I just know L through B) friend's health and is lashing out and I'm probably the safest target because she knows I'm conflict averse and far away and I've already let her pull this shit on me.
It's just sucky and disconcerting and, no matter how much I try to shake it off, it fucking hurts.
Friends that bring you only stress, better off without. Still sucks, though.
