Every now and then, I think I might actually be a little odd.

Even if it wasn't a hate crime (which it was), it was still murder. The man should be arrested and tried for first-degree murder, regardless of his ethnicity, or his racism or lack thereof.

How could Z. have been threatened? He was in an SUV with a gun, on the phone with 911 telling him not to engage. The boy was on foot and unarmed. This is premeditated murder.

actually, his state of mind can be crucial in escalating a charge from manslaughter to murder, or from an assault to a hate crime. There is also a common law concept called "imperfect self defense", which means that the defendant was truly afraid and acted in self defense, but a "reasonable man" would not have been afraid in those circumstances. I'm not sure that it could be used here, though.

Either way, he should have been brought in for questioning, because no matter what else, he shot an unarmed man in the street.
