No, I'm mixed up - I'm thinking of Gloin (Gimli's dad), who Thranduil once had imprisoned, hence the distrust between Gimli and Legolas when they met.
I do vaguely recall that Tolkien retconned why Legolas hadn't appeared in The Hobbit, but now I have no idea what the reason was. He was off somewhere doing something.

A quick search showed Orlando displaying skepticism at the idea of appearing in the movie. As much as I adore the character, I don't think the story should be rejiggered to pander to me.

If they just want him in the background somewhere, I'm sure they have enough motion-capture to make that happen without Orlando's involvement. If Legolas is in this movie at all, it should be as an easter egg, not a speaking role.
