For me, Dean was reapered to heaven while Gabriel attempted to "school" Sam on living without his brother, all under Lilith's nose. I wouldn't think Gabriel gave a fig about Lilith or her contract. And it's really the only way to justify that Ash has seen both boys in Heaven before (even though plot holes have been known to exist before).
