I can help a very little. And I think I don't have to discard a last card if I have one since the next player's turn is my own.
I can see why attempting the check would be preferable to losing 5 cards.
It would be interesting to see... I imagine there are circumstances where folks might intentionally fail this check to get a difficult customer into the brig. Everyone's been playing on the up and up so far though, as far as I can tell. Brigging someone would probably be more harmful than not.
