I just read the story
1) she had a really bad lawyer.
2) yes, there are pop ups that you don't have to click on

But 40 years - that's just stupid. and if she did call for help and got none, there are bigger problems at the school and she is the scapegoat.

By a couple of years, apparently -- which as I understand it means the school system is out of compliance with all kinds of child protection laws, and makes me think that, while she may not be the brightest of bulbs, she's getting the shaft in the system's place.
I'm not a big believer in filter software, but I can't imagine not having it at a school. Too many kids to watch and keep an eye on. and there are sights that pop things up on you screen

And to defend teachers, most schools do try to give them computer training, but substitutes have no such resources. They typically get paid between $50-$75 per day, I might add. $100 at the most.

You know, I just... I'm sorry, get scolded for turning the computer off when it's showing porn? No. That's just dumb. She could have unplugged the computer or taped paper over the monitor, or something. But sitting in front of the computer all day, clicking on the porn and putting her body in front of the monitor so the kids didn't see something? Oh, please.
And yeah, the articles I read made me think her lawyer was as stupid as she was.

You know how soldiers can be tried for doing evil, even if they were "just following orders"? I suspect that teacher was convicted under that sort of rationale. You don't follow orders that are wrong. You say to the asshat on the phone, "Look, you send someone down here to fix this thing or I'm shutting it off. The students can't be exposed to this."
40 years is ridiculously excessive, but she was wrong to do what she was told. She shouldn't be the only one punished, though.
But is it fair to provide absolutely no computer training to someone who is computer illiterate and yet blame them when they don't know how to deal with the technology? I don't think the "following orders" things holds up--all soldiers are trained in detail about the Geneva Convention and know, techincally, how to deal with those situations. She didn't have that training at all.
Yes, she should have unplugged the computer. But she did call the office numerous times, and she did try to cover the screen. I can very honestly believe that she may not have had a clue how to turn the thing off, and believe me, schools put the fear of God into subs about "damaging technology." It wouldn't surprise me if she thought she'd cripple the computer and be responsible for the cost of the repair if she unplugged it.
I'm sorry, but if the school hadn't let their filters lapse or checked for spyware or adware, then she is not the one responsible for the students' exposure.
