Yes I was talking about Xbox live. It is my roommate's Xbox and he bought it used at a (I'm not sure which one but one of those game-exchange places.)
If there's a single mod-chip in there and you go on Xbox Live you will be banned FOREVER.

How can we find out if this is the case?
Well, did you buy it from somewhere like EB Games or Gamestop? They should have some kind of guarantee that the box isn't modded. Have your roommate check with wherever it was purchased from.
Besides that, I'm not absolutely sure how you can check, as I've never modded a box. I'm sure there's plenty info out there on the interwebby.
