My parents own one. It's quite useful for hauling large things, and gets decent gas mileage. The back seat is set so high, though, that I got even more carsick than usual back there.
Mine have a CRV, which is nice enough and has many of the Element advantages, but I find the Element more comfortable. For some reason, the CRV feels overly padded.

I asked my buyer's agent this, and she seemed kind of taken aback and squirmy about it, but is it illegal for sellers to make up other phantom buyers? Or just highly unethical? or just, "eh, it happens"?
