fuck this. Can you go to the attorney general? In this climate, I think the AG might be sympathetic. I also think you need to file a Fed Reserve or OCC complaint. I'm serious. If they are being this assholey, perhaps you have nothing to lose.
BTW, I suspect the judge might rule in your favor. I think you should take a chance with the judge. I know your personal reserves are worn out, but hang in there.

Laura, maybe contact your federal Senator. Especially if they are Democrat. I think they would love to champion your cause in this election year. Also, I can't help but wonder, if the bank is wanting your house for other reasons. Like, are they trying to swindle all the houses in an area for freeway bypass, or train, or mineral rights, or some such. It seems odd that you are trying to make payments, and they won't let you. And on top of that, they are not giving you a list of the charges?!? Crazy.

IOmerealestateN, the place I have the offer on, the short sale, a negotiator for the selling bank has been assigned. This is step 2 of the process (step one being the offer itself). The fact it took only a couple weeks rather than 4-6 is a good sign. And it's Wachovia bank, which apparently handles short sales better than most.
le nubian, I think you are right on this. My attorney is a relaxed easy going real estate guy and I think I am going to switch to an aggressive 'sue the bastards' type. My nature is to assume I am dealing with rational logical people, but this clearly is not the case. They have been abusive in so many ways including force placing windstorm insurance when it was not required for the first 8 years of my mortgage. Um, can't just change the rules and charge me 20k for overpriced never before required insurance. At this point I think I have to counter sue to show them I am not giving them my house.
