A challenge to the prop before the election might have been dismissed because of concerns for ripeness -- it's a complicated doctrine but generally courts can decline to hear cases where the claimed harm has not yet and may never come to pass.

And in terms of ruling on principle. Aside from whatever legal doctrines may come into play, California has a provision where judges have to be confirmed by being reelected occasionally. The possibility of being Elizabeth Rose Birded has to cross their minds when making rulings.

I am a woman of various inclinations and only some of the time are they to burn everything down in frustration

It's still shocking to me that we can apparently amend the constitution with a simple majority on a voter initiative but we can't approve a budget without 2/3 of the legislature. That's just bizarre.

I would love it if some city clerk decides to start issuing marriage licenses with the dates altered so they fall into that window of legality.

Speaking of the back of the bus, this story from livejournal from over the weekend is pretty appalling. A black guy was kicked out of a bar here in NYC, presumably because of dress code. However, his black coworker was also not let in, wearing the same uniform their white coworkers were apparently fine in, AND a visibly drunk white guy wearing apparently the same outfit as our original poster was let in no problem.
