Interesting. From skimming, it seems like it did come down to how much direct quoting & paraphrasing was in the Lexicon. And given the examples in there, I'd have to agree it was way, way too much. Sheesh.

But he also says

While the Lexicon, in its current state, is not a fair use of the Harry Potter works, reference works that share the Lexicon's purpose of aiding readers of literature generally should be encouraged rather than stifled.

He definitely awarded much less than Rowling & Time Warner were looking for.

Yep. Otherwise, he would have been in the clear. The judge agreed that reference works like the Lexicon were generally fair use. SVA just fucked it up.
