Kat it sucks, and I really think that legal relief is possible. One thing is that when the employer screwed up they had an obligation to mitigate - finding the error and correcting as soon as possible. At the very least I don't think you overpay over a period of time, in a format where employees can't really catch the error, and then charge interest if employees cannot pay it back quickly. I am not a lawyer, but I can't help suspect that a lawsuit requiring them to accept payment interest free over a period of 12-18 months would be successful. Also having given that much money over a long period of time, without a reasonable means for the employee to check, I would say you have given them good reason to believe the money is theirs and spend it. So it is a hardship to pay it back; and I suspect a lawyer could make a good case for letting employees keep at least a portion of it. I suspect in an actual lawsuit, a lawyer would file a claim for keeping all the money, plus being paid extra for mental anguish, if mental anguish is allowed under the laws of your state (which it might not be), and then settle for waiving the interest and part of the principal. But again, not a lawyer, and we have lawyers on the board who might have thoughts.

Amy, they will agree to take it out of future paychecks. But it works that you have to take a loan FROM the District, sign a promissory note, sign the check over to them so as not to fuck up your next set of taxes for this year, and then pay it back within 12 months.
And thank you for the comment about Noah and Grace. I stayed home today and Noah? Not so adorable with his I-hate-the-world-and-I'm-inconsolable fussing at noon.

With plantar fasciitis, I thought the arch brace [link] worn night and day helped as much as anything, in addition, of course, to stretching, stretching, stretching. When it really hurts, rolling a frozen water bottle with your foot helps. Most of the OTC shoe inserts labeled for "heel pain" seem to help, also.
