Absolutely. Substantial modification may absolve a manufacturer of liability during litigation but I'm loooking for a way to indemnify it before.

I'm thinking of things like spray paint where the weight of the disclaimer rests on the product being *used as intended* before the manufacturer assumes any liability. Maybe there's something there to build on?
