I wouldn't be surprised at all if the judge had no idea of the prison retrofitting connection. And the two brothers do not share the same last name. The engineer is Michael Scofield. The death row brother is Lincoln Burrows.
It's the
criminal justice system.
It's hard as it is getting the arresting cops to show up. Believe me, NO ONE is checking to see if you worked for a place that designed the prison. It would be very hard to have all the engineering firms on tap, and that's
given
that knowing how a place was designed means it's easy to escape from it.
I'm with bon bon. I haven't seen the pilot, but if the premise is that a guy who designed a prison has a brother in that prison, it wouldn't be too hard to figure out what crime to commit and where to commit it to get sent to the same prison. And there's no way in hell the system would connect the dots, in fact, it's possible they wouldn't even put together that he had a brother in the same prison.

Wolfram, between that post and your tag, "Part of the PROBLEM since 2002" I'm picturing a whole new career for you. You can advise people who want to break their family out of the joint on which crimes they should commit, and where.

Wolfram, from what I've seen in the commercials, the older brother (Dominic Purcell) designed the prison he's incarcerated in. His younger brother, convinced that the older brother is innocent, commits a crime, gets put in the same prison with the sole purpose of breaking his older brother out since his older brother helped design the prison. It's just convoluted enough to make my head hurt but if ita and Kristen are right about the shirtlessness, then I may have to handwave. Although, after they break out, it'll be The Fugitive but with more people on the run.
Also, to be clear,
the firm he worked for didn't build the prison. IIRC, they were hired to retrofit it with some stuff a few years before the opening of the series.
ETA: And actually I had to go look and
it wasn't even his firm that was hired to do the work. It was another firm that was hired in 1999 and they couldn't do the job so they subcontracted, under the table, to another firm. Which is the brother's firm.
