Don't people have to agree to be a child's guardian in the event of the death of a parent?

[NAFDA] This is where we talk about the show! Anything that's aired in the US (including promos) is fair game. No spoilers though -- if you post one by accident, an admin will delete it.
Don't people have to agree to be a child's guardian in the event of the death of a parent?
YES!!!!! But the way these stories usually go is that if the person doesn't take the kid, it would go into foster care, and who wants that, etc.
It's fortunate that Best Friend's wife has lots of siblings. Frankly, I think the kids would have better chances getting the required supervision and affection at the orphanage than they would if I were saddled with them.
So I was watching Sacrifice tonight on my DVDs and I notice Fred saying, "I never want to be a shell" or something close to that.
I like the foreshadowing. This is one of the reasons why it's fun to go back and watch again.
Yeh, I heard that too, and shuddered.
GUNN
You heard Angel. Feelings don't
enter into it anymore.
Fred stops.
FRED
That the world we're fighting for?
The right to be heartless? An
uncaring shell... To be dead inside?
GUNN
We're gonna be dead, period, if
Jasmine gets a hold of that kid.
We're fighting for our survival.
FRED
That's not enough, Charles. Not for
me. Maybe you can turn off your
feelings like Angel. Leave people we
care about behind--
GUNN
Well, you had no trouble switching
off your emotion chip when--
He stops himself, shakes his head, then continues on.
FRED
When what?
GUNN
Nothing.
FRED
What were you going to say?
GUNN
Forget it.
FRED
(grabbing his arm)
No. When did I ever--
GUNN
(turning to her)
When you and I killed a man.
Fred stares at him, stunned he's brought it up.
GUNN (cont'd)
I mean... when I did.
FRED
We did.
GUNN
Whatever. Point is, when the
circumstances called for it, you did
what you thought you had to do.
Didn't matter what any one else
thought. The people around you.
Fred looks at him a beat.
FRED
You're right about it all except for
one thing. What we did... I felt
it. Every bit of it. And, y'know,
sometimes, when I let myself think
about it... It eats me up inside.
GUNN
Yeah. Me, too.
FRED
Well, I don't know about you... But
I'll take that over being a shell
anyday.
It's even more ironic when you consider that in both season 4 and seaon 5, it's Gunn who's is pivotal in Fred becoming a "shell," perceived or real. Eek. That's why I loved these shows, they put so damn much thought into what they wrote.
You know, ConCord really doesn't get any less eww-ey the second time you see Apocalypse Nowish.
Nor the third, fourth, or fifth. I can't speak to beyond that, but I expect a very slow Eww-level descent.
